Terms & Conditions of Service
Please read these Terms carefully. They contain important information about your rights and obligations when using Tidy Torch cleaning services.
These Terms and Conditions of Service (“Terms”) constitute a legally binding agreement between Tidy Torch LLC, an Arizona limited liability company (“Tidy Torch,” “Company,” “we,” “us,” or “our”), and the individual or entity purchasing, scheduling, requesting, or receiving services from Tidy Torch (“Customer,” “Client,” “you,” or “your”).
By accessing our website, requesting a quote, scheduling or booking a service, providing payment information, electronically accepting these Terms, permitting our personnel to enter the property, or otherwise accepting or receiving services from Tidy Torch, you acknowledge that you have read, understood, and agree to be bound by these Terms.
If you do not agree to these Terms, you should not book or use Tidy Torch services.

Services
Tidy Torch provides residential, apartment, commercial, and other cleaning services made available by the Company from time to time.
Available services may include:
- Standard Cleaning
- Recurring Cleaning
- Deep Cleaning
- Move-In Cleaning
- Move-Out Cleaning
- Apartment Cleaning
- Commercial or Office Cleaning
- Hourly Cleaning
- Add-On Cleaning Services
- Other cleaning-related services expressly offered by Tidy Torch
- The scope of each service is determined by the service description, cleaning checklist, quote, work order, booking confirmation, selected add-ons, and any other written terms applicable to the Customer’s booking.
- Services not expressly included in the selected service are not included merely because they may ordinarily be associated with cleaning a property.
Customer Responsibility To Provide Accurate Information
Pricing, staffing, estimated duration, and service recommendations are based upon information provided by the Customer.
You agree to provide complete and accurate information concerning the property and requested services, including, as applicable:
- Square footage
- Number of bedrooms
- Number of bathrooms
- Number of kitchens or other significant rooms
- Property type
- Property condition
- Amount of buildup
- Approximate date of the last professional cleaning
- Presence and number of pets
- Pet hair or excessive shedding
- Occupancy status
- Excessive clutter
- Smoke or odor conditions
- Interior appliances requested for cleaning
- Interior cabinetry requested for cleaning
- Special surfaces or finishes
- Access conditions
- Parking restrictions
- Stairs or unusual structural conditions
- Any circumstance reasonably likely to increase the time, labor, materials, or risk required to perform the service
- If the property is materially larger, dirtier, more cluttered, or otherwise different from the information provided when the service was quoted or booked, Tidy Torch may modify the scope, estimated completion time, staffing, or price.
- When reasonably practicable, we will notify you of a material adjustment before performing substantial additional work.
- If you decline an appropriate adjustment, Tidy Torch may limit the service to what can reasonably be completed under the original booking or decline or reschedule the service.
Quotes And Estimates
Unless expressly identified as a guaranteed fixed price, quotes and estimates are based upon the information reasonably available to Tidy Torch before service.
A quote may be adjusted when:
- Information provided during booking was inaccurate or incomplete
- The property condition materially differs from the description provided
- Additional services are requested
- Additional rooms or areas are added
- Excessive buildup or clutter is present
- Pets or other conditions were not disclosed
- The Customer requests additional cleaning time
- Access or working conditions materially increase the work required
- Other circumstances materially affect the labor or resources required
- Tidy Torch will not knowingly impose undisclosed charges for services that were neither requested nor reasonably necessary under an authorized pricing adjustment.
Service Results And Cleaning Expectations
Tidy Torch will use commercially reasonable efforts to perform services in a professional manner consistent with the service purchased.
Cleaning is not restoration.
The Customer acknowledges that some conditions cannot be fully corrected through ordinary cleaning, including:
- Permanent staining
- Hard-water damage
- Mineral deposits
- Rust
- Etching
- Scratching
- Paint damage
- Damaged or deteriorated grout
- Mold staining
- Excessive grease buildup
- Burned surfaces
- Worn or damaged finishes
- Discoloration
- Permanent odors
- Aged caulking
- Material deterioration
- Other pre-existing conditions
- Tidy Torch does not warrant or guarantee that a surface will be restored to new or like-new condition.
Satisfaction Guarantee And Re-Clean Policy
Because cleaning services involve labor that has already been performed and cannot be returned, completed cleaning services are generally non-refundable except as otherwise required by applicable law or expressly approved by Tidy Torch.
If you believe an area included within your booked scope of service was missed or was not cleaned to the applicable Tidy Torch service standard, you must notify us within twenty-four (24) hours after completion of the service.
Your notice should identify the specific areas of concern and, when reasonably possible, include photographs.
Upon receiving a timely and qualifying complaint, Tidy Torch may elect to provide a complimentary re-clean of the affected area.
A re-clean:
- Applies only to areas included in the original scope of service
- Does not include additional rooms, services, or add-ons
- Does not convert a Standard Cleaning into a Deep Cleaning
- Does not apply to permanent stains or conditions that cleaning cannot reasonably remove
- Must occur within a reasonable time designated by Tidy Torch
- Requires the Customer to provide reasonable access to the property
- A Customer who refuses a reasonable opportunity for Tidy Torch to inspect or re-clean a qualifying issue may forfeit the Company’s voluntary re-clean remedy.
- Complaints submitted more than twenty-four (24) hours after service may be considered at Tidy Torch’s discretion but are not guaranteed to qualify for a complimentary re-clean.
Customer Walkthroughs And Approval
Customers are encouraged to inspect completed work when present at the property.
Approval may be communicated orally, by text message, email, electronic communication, or other reasonable means.
Customer approval does not waive rights that cannot legally be waived. However, an affirmative inspection and approval may be considered when evaluating a subsequent complaint regarding a condition reasonably observable during the inspection.
If a Customer requests that a cleaning team remain at the property for an extended walkthrough or inspection after completion, additional waiting time may be chargeable if disclosed and approved.
Cleaning Professionals And Team Assignments
Services may be performed by one or more cleaning professionals.
Tidy Torch may use employees, independent contractors, subcontractors, or other authorized service professionals consistent with applicable law and Company operations.
Team size and assignments may vary depending upon:
- Property size
- Service type
- Scheduling
- Employee or contractor availability
- Illness
- Vacation
- Training
- Operational requirements
- Other business considerations
- Although Tidy Torch may attempt to provide consistency for recurring Customers, we do not guarantee that the same individual or team will be assigned to each visit.
- All contractual, pricing, payment, rescheduling, complaint, and service-scope matters must be addressed directly with Tidy Torch rather than individually with cleaning personnel.
Professional Conduct
Tidy Torch personnel are expected to conduct themselves professionally and respectfully while on Customer property.
Likewise, Customers and persons present at the property must treat Tidy Torch personnel professionally and respectfully.
Tidy Torch maintains the right to immediately stop or refuse service when personnel experience:
- Threats
- Violence
- Harassment
- Sexual harassment
- Discriminatory conduct
- Intimidation
- Abusive behavior
- Unsafe conditions
- Other inappropriate conduct
- Depending upon the circumstances, the Customer may remain responsible for charges associated with the reserved service time.
Arrival Windows
Appointment times are scheduling estimates and may include an arrival window.
Traffic, weather, previous appointments, property conditions, staffing, accidents, road closures, emergencies, or other circumstances may affect arrival times.
Unless expressly guaranteed in writing, an appointment time is not a guarantee that personnel will arrive at the exact stated minute.
Tidy Torch will make reasonable efforts to notify Customers of material delays.
Recurring Cleaning Services
Recurring service pricing may depend upon the frequency of service.
Recurring schedules may include:
- Weekly
- Bi-weekly
- Every four weeks/monthly
- Another agreed frequency
- Pricing assumes that approximately the agreed amount of time will pass between cleanings.
- If a recurring Customer skips, cancels, or significantly delays a cleaning, the condition of the property at the subsequent visit may require additional labor.
- Accordingly, the next service may be repriced based upon the actual interval or property condition.
- For example, a bi-weekly Customer who skips one cleaning may create an approximately four-week cleaning interval, which may result in the applicable monthly or increased service rate for the next cleaning.
Change Of Service Frequency
Changing the frequency of recurring cleaning may change the recurring rate.
Customers should contact Tidy Torch before changing a recurring schedule.
Tidy Torch reserves the right to periodically review recurring service pricing based upon:
- Actual cleaning time
- Property condition
- Labor cost
- Supply cost
- Changes to the property
- Changes in requested scope
- Market conditions
- Other legitimate business considerations
- Any revised rate will apply prospectively.
Move-In And Move-Out Cleaning
Unless otherwise agreed in writing, move-in and move-out cleaning pricing assumes the property will be vacant or substantially empty at the time service begins.
The Customer is responsible for removing personal belongings from areas to be cleaned.
When interior cleaning is requested:
- Refrigerators must be emptied
- Cabinets and drawers must be emptied
- Closets should be emptied where interior cleaning is included
- Appliances and storage areas must be reasonably accessible
If the property remains occupied, contains substantial personal belongings, or otherwise does not meet the conditions upon which the service was priced, Tidy Torch may:
- Change the service classification
- Increase the quoted price
- Add cleaning time
- Limit the scope
- Reschedule the service
- Decline the service
- Tidy Torch does not provide specialized odor remediation, pest remediation, mold remediation, hazardous-waste remediation, biohazard remediation, or restoration services unless expressly agreed in writing.
Hourly Cleaning
When hourly cleaning is offered, the Customer purchases a specified quantity of cleaning labor rather than guaranteed completion of an unlimited task list.
Tidy Torch will use the scheduled time to address reasonable cleaning priorities.
If there is insufficient time to complete all requested tasks, personnel may prioritize:
- Customer-identified priorities
- High-use areas
- Bathrooms and kitchens
- Areas requiring the most immediate attention
- Other tasks that can reasonably be completed within the purchased time
- Completion of all requested tasks is not guaranteed when the Customer purchases insufficient time.
- Additional time is subject to availability and additional charges.
Additional Services And Extra Work
Customers should request additional services before the appointment whenever possible.
Additional services may include, when offered:
- Interior oven cleaning
- Interior refrigerator cleaning
- Interior cabinet cleaning
- Additional bedrooms
- Additional bathrooms
- Interior windows
- Baseboards
- Garage cleaning
- Other additional rooms or spaces
- Other add-ons offered by Tidy Torch
- Cleaning personnel may not have authority to negotiate prices or materially modify the work order while at the property.
- All substantial additions should be authorized through Tidy Torch.
Clutter And Personal Property
Cleaning results depend upon reasonable access to surfaces and floors.
Customers should remove excessive clutter before the appointment, including:
- Clothing
- Toys
- Paperwork
- Personal effects
- Dishes
- Trash
- Loose objects
- Items that obstruct cleaning surfaces
- Tidy Torch may clean around excessive clutter rather than move or organize personal possessions.
- If clutter materially increases the labor required, Tidy Torch may charge additional amounts, modify the service, or leave inaccessible areas uncleaned.
- Tidy Torch is not responsible for misplaced items that personnel reasonably move a short distance for cleaning unless caused by negligence or other liability imposed by applicable law.
Pets
Customers must disclose pets located at the property.
For safety, Customers should secure pets that:
- Are aggressive
- Are territorial
- Are anxious around strangers
- May interfere with cleaning
- May attempt to escape
- Otherwise present a safety or access concern
- Tidy Torch personnel will use reasonable care when entering and exiting a property but cannot guarantee that an unsecured pet will not escape.
- To the extent permitted by law, Tidy Torch is not responsible for an unsecured pet escaping while personnel are reasonably entering or leaving the property absent negligence by Tidy Torch.
Tidy Torch does not ordinarily clean:
- Litter boxes
- Animal feces
- Animal urine
- Vomit
- Other potentially biohazardous pet waste
- Excessive pet hair or other pet-related cleaning conditions may result in additional charges when disclosed through the booking or adjustment process.
Pests And Infestations
Tidy Torch may refuse or discontinue service in areas affected by active infestations, including:
- Bed bugs
- Fleas
- Cockroaches
- Termites
- Significant ant infestations
- Rodent infestations
- Other pests presenting health or contamination concerns
- A Customer should arrange appropriate pest-control treatment before cleaning areas affected by an active infestation.
Health And Safety
Tidy Torch reserves the right to refuse, suspend, discontinue, or limit service where conditions present a reasonable health or safety risk.
This may include:
- Human bodily fluids
- Animal waste
- Needles
- Sharps
- Hazardous chemicals
- Hazardous materials
- Significant mold
- Biohazards
- Unsecured firearms
- Illegal activity
- Unsafe structural conditions
- Exposed electrical hazards
- Lack of functioning utilities
- Extreme indoor temperatures
- Aggressive animals
- Pest infestations
- Excessive hoarding
- Unsafe access
- Any condition outside Tidy Torch’s training, equipment, insurance, or ordinary scope of services
Hoarding And Extreme Conditions
Properties involving hoarding, severe accumulation, excessive trash, or extreme cleaning conditions require specialized evaluation.
If such conditions were not disclosed before service, Tidy Torch may:
- Convert the service to an hourly or specialty rate
- Increase staffing
- Require additional time
- Provide a revised estimate
- Reschedule
- Require remediation by a specialized provider
- Decline service
- Tidy Torch does not perform biohazardous hoarding remediation unless expressly offered and properly equipped to do so.
Equipment And Cleaning Supplies
Unless otherwise stated, Tidy Torch or its service professionals will provide ordinary cleaning products, supplies, and equipment reasonably necessary for the booked service.
If you require a particular product to be used or avoided because of:
- Allergies
- Chemical sensitivities
- Manufacturer instructions
- Specialty surfaces
- Personal preference
- Other concerns
- you must notify Tidy Torch before the appointment.
- If a Customer directs Tidy Torch to use a Customer-provided product, Tidy Torch is not responsible for damage caused by defects in that product, undisclosed incompatibility, incorrect manufacturer information, or risks that were not reasonably known to Tidy Torch, except to the extent liability cannot lawfully be excluded.
Specialty And Delicate Surfaces
Customers are responsible for notifying Tidy Torch of any specialty or delicate surfaces requiring special treatment.
Examples include:
- Natural stone
- Marble
- Travertine
- Unsealed stone
- Antique wood
- Specialty flooring
- Hand-painted surfaces
- Custom finishes
- Delicate fixtures
- Specialty metals
- Manufacturer-restricted materials
- Tidy Torch may decline to clean a surface if personnel reasonably believe cleaning may damage it.
Wall Cleaning And Spot Cleaning
Wall cleaning presents inherent risks because paint composition, finish, age, prior repairs, preparation, and durability vary.
Possible outcomes include:
- Paint transfer
- Fading
- Finish changes
- Discoloration
- Exposure of previous damage
- Paint removal
- Tidy Torch may test a small area or decline wall cleaning when the surface appears unsuitable.
- Customers requesting wall cleaning acknowledge these inherent limitations.
- Nothing in this section releases Tidy Torch from liability that applicable law does not permit the Company to disclaim.
Working At Heights
For safety reasons, cleaning personnel will not perform tasks requiring unsafe ladder use or work at substantial heights.
Personnel generally will not climb higher than a standard household step stool or approximately the first two safe ladder steps or rungs.
Fixtures, ledges, windows, fans, or other areas that cannot be safely accessed may not be cleaned.
Heavy Items, Furniture, And Appliances
Tidy Torch personnel are not required to lift or move heavy furniture, major appliances, or other objects that may create risk of injury or property damage.
This includes:
- Refrigerators
- Ovens or ranges
- Washers
- Dryers
- Large entertainment centers
- Heavy furniture
- Safes
- Other heavy objects
- If cleaning behind such an item is requested, the Customer must safely move the item before the cleaning appointment unless Tidy Torch expressly agrees otherwise.
Interior Appliances And Cabinets
When interior refrigerator, oven, cabinet, drawer, closet, or similar cleaning is booked, the applicable area should be emptied before personnel arrive.
If it is not emptied, personnel may:
- Clean around remaining items
- Decline that portion of the service
- Require additional paid time
- Reschedule the add-on
Services We Do Not Provide
Unless expressly agreed otherwise, Tidy Torch does not perform:
- Biohazard remediation
- Human bodily-fluid cleanup
- Animal-waste remediation
- Needle or sharps removal
- Hazardous chemical cleanup
- Mold remediation
- Pest extermination
- Crime-scene cleaning
- Significant construction cleanup
- Structural repairs
- Electrical work
- Plumbing work
- Childcare
- Pet care
- Meal preparation
- Medical services
- Personal-care services
- Restoration work
- Exterior work requiring specialty equipment
- Tasks requiring unsafe climbing
- Work outside the ordinary scope of professional cleaning
Property Access
The Customer is responsible for providing safe and timely access to the property.
Access methods may include:
- Door code
- Smart lock
- Lockbox
- Key
- Property manager
- Concierge
- Authorized representative
- Customer entry
- The Customer is responsible for ensuring that any access instruction provided is accurate and current.
- Tidy Torch will take reasonable measures to protect access information but cannot guarantee the security of third-party access systems outside its control.
Lockouts And Inaccessible Properties
If personnel arrive during the scheduled arrival window and cannot reasonably access the property, Tidy Torch may attempt to contact the Customer.
If access cannot be obtained within a reasonable period, the appointment may be treated as a late cancellation or lockout.
The Customer may be charged the applicable late-cancellation, lockout, travel, or reserved-service fee disclosed by Tidy Torch.
No refund is required for prepaid services when performance was prevented by the Customer’s failure to provide agreed access, except as otherwise required by law.
Security Systems
Customers are responsible for providing accurate security-system instructions or ensuring that alarms are disabled as necessary for service.
Tidy Torch is not responsible for alarm charges or other expenses caused by inaccurate or incomplete access information supplied by the Customer unless caused by Tidy Torch’s negligence or otherwise required by law.
Utilities And Working Conditions
Customers must provide reasonable access to functioning:
- Water
- Electricity
- Indoor lighting
- Climate conditions suitable for safe work
- Tidy Torch may decline or discontinue service when necessary utilities are unavailable.
- If the lack of utilities or other working conditions was not disclosed and prevents performance after personnel have been dispatched, applicable cancellation or reserved-time charges may apply.
Other Contractors And Service Providers
The Customer is responsible for ensuring that other contractors, movers, repair personnel, occupants, or service providers do not materially interfere with Tidy Torch’s ability to perform the scheduled cleaning.
Tidy Torch may suspend, limit, or reschedule work if simultaneous activity makes cleaning unsafe or impracticable.
Cancellation Policy
Cleaning appointments reserve personnel and prevent Tidy Torch from accepting other work during that time.
Customers should cancel or materially reschedule an appointment at least twenty-four (24) hours before the scheduled service time.
A cancellation, significant rescheduling request, or service reduction made less than twenty-four (24) hours before the scheduled service may be subject to Tidy Torch’s then-current late-cancellation fee.
The amount of any applicable cancellation fee will be disclosed through the booking system, quote, confirmation, or other applicable policy.
Same-day cancellations, lockouts, no-shows, or cancellations after personnel have been dispatched may result in a charge reflecting reserved labor and expenses, subject to applicable law.

Giving notice only to an individual cleaner does not constitute effective cancellation notice unless Tidy Torch receives or confirms the notice.
Rescheduling
Customers may request to reschedule an appointment.
Requests made at least twenty-four (24) hours in advance will generally not incur a late-cancellation fee unless otherwise disclosed.
Repeated rescheduling, same-day rescheduling, or rescheduling after personnel have been dispatched may be treated as a late cancellation.
Rescheduling a recurring appointment may change the interval between cleanings and therefore change the rate for the subsequent service.
Cancellation Or Refusal By Tidy Torch
Tidy Torch may cancel, refuse, limit, suspend, or discontinue a service when reasonably necessary because of:
- Unsafe conditions
- Employee or contractor safety concerns
- Aggressive animals
- Biohazards
- Infestations
- Lack of utilities
- Inability to access the property
- Materially inaccurate booking information
- Interference by other parties
- Harassment or threatening behavior
- Nonpayment
- Fraud or suspected fraud
- Requested work outside our scope
- Illegal activity
- Other circumstances making performance unsafe, unlawful, or commercially unreasonable
- When reasonable under the circumstances, Tidy Torch will notify the Customer.
Payment Terms
Customers agree to pay all amounts authorized in connection with their booking.
Tidy Torch may require:
- Payment at booking
- A deposit
- A valid payment method on file
- A payment authorization
- A temporary authorization hold
- Payment following completion
- Accepted payment methods are determined by Tidy Torch and its payment processor.
- Cash may be accepted only when expressly approved by Tidy Torch.
Payment Processing
Electronic payments may be processed by third-party payment providers.
Tidy Torch does not control the availability, security, or internal processing systems of third-party payment providers.
A failed transaction does not eliminate the Customer’s obligation to pay for authorized services.
Receipts
Receipts are generally delivered electronically after successful payment.
Customers are responsible for providing an accurate email address and other contact information.

Chargebacks And Payment Disputes
If you believe a charge is incorrect, you agree to make a reasonable effort to contact Tidy Torch promptly so that the matter can be reviewed.
Nothing in these Terms prevents a Customer from exercising lawful rights available through a card issuer, bank, payment network, or applicable law.
However, knowingly initiating a fraudulent chargeback or falsely representing an authorized service as unauthorized may constitute a breach of these Terms and may result in Tidy Torch declining future services.
Tidy Torch reserves the right to provide booking records, service records, photographs, communications, payment authorizations, and other relevant documentation to a payment processor or financial institution when responding to a payment dispute.
Taxes
Applicable sales, transaction privilege, or other taxes may be charged when required by law.
Gift Cards, Service Credits, And Promotions
Gift cards may be used toward eligible Tidy Torch services according to the terms applicable at issuance.
Except as required by applicable law:
- Gift cards are not redeemable for cash
- Promotional credits have no cash value
- Promotional offers may have eligibility restrictions
- Promotional discounts may not be combined unless expressly permitted
- Any remaining eligible gift-card balance may generally be used toward future services.
Tips And Gratuities
Gratuities are appreciated but never required.
Customers may provide gratuities electronically when supported by the booking/payment platform or directly to cleaning personnel.
Tidy Torch intends for gratuities designated for cleaning professionals to be distributed in accordance with applicable law and Company procedures.
Valuables
Before service, Customers should secure:
- Cash
- Jewelry
- Collectibles
- Firearms
- Prescription medication
- Important documents
- Irreplaceable items
- Family heirlooms
- Fragile antiques
- Other high-value property
- Customers should notify Tidy Torch in advance of unusually fragile or valuable items requiring special care.
Pre-Existing Damage
Tidy Torch is not responsible for damage resulting solely from:
- Pre-existing defects
- Normal wear and tear
- Loose fixtures
- Deteriorated materials
- Improper installation
- Poor construction
- Unstable furniture
- Improperly mounted pictures or décor
- Deteriorated caulking or grout
- Existing scratches, chips, cracks, or stains
- Manufacturer defects
- Other conditions not caused by Tidy Torch
- Tidy Torch may photograph pre-existing damage when reasonably necessary for documentation.
Damage Or Breakage Claims
Tidy Torch takes reports of property damage seriously.
If you believe Tidy Torch personnel damaged property, you must notify the Company as soon as reasonably practicable and preferably within twenty-four (24) hours after service.
Your report should include:
- A description of the damage
- Photographs
- The location of the item
- Any available proof of value
- Other information reasonably requested for investigation
- The twenty-four-hour reporting request is intended to allow prompt investigation and does not eliminate any non-waivable legal right solely because the Customer failed to report within that period.
- Tidy Torch reserves the right to inspect, investigate, obtain photographs, communicate with personnel, and review service records before determining responsibility.
If Tidy Torch accepts responsibility for covered damage, Tidy Torch may, as appropriate and subject to applicable law:
- Repair the item
- Arrange professional repair
- Replace the item with a reasonably comparable item
- Compensate the Customer based on reasonable actual value, taking condition and depreciation into account
- Submit the claim to the Company’s insurance carrier
- Tidy Torch does not guarantee replacement of sentimental value, subjective value, or an undocumented claimed value.
Fragile, Antique, And Irreplaceable Items
Customers should remove or identify unusually fragile, antique, irreplaceable, or high-value items before cleaning.
Tidy Torch may decline to handle an item that reasonably presents an unusual risk of damage.
Wall Hangings And Decor
Customers are responsible for ensuring wall décor, artwork, shelving, mirrors, frames, and similar items are properly and securely installed.
Tidy Torch is not responsible for damage resulting from improper mounting, deteriorated hardware, unstable fixtures, or pre-existing defects except to the extent caused by Tidy Torch’s negligence or otherwise required by law.
Suspected Theft
Any suspected theft should be reported promptly to Tidy Torch at:

Tidy Torch may investigate the allegation and may request supporting information.
When theft is reasonably suspected, Customers are encouraged to file a police report and cooperate with lawful investigation procedures.
Tidy Torch will cooperate with appropriate law-enforcement inquiries as required by law.
No provision in these Terms requires a Customer to waive a lawful theft claim.
Before, During, And After Photographs
Tidy Torch may take photographs or videos before, during, or after service for legitimate business purposes, including:
- Documenting initial property condition
- Quality control
- Training
- Verifying completion
- Documenting damage
- Responding to complaints
- Responding to payment disputes
- Safety
- Internal records
- Tidy Torch will use reasonable care not to intentionally capture private documents, identifying information, or other sensitive material that is unrelated to the service.
Marketing Use Of Photographs
Tidy Torch may separately use non-identifying before-and-after photographs for marketing, social media, advertising, website content, or portfolio purposes where appropriate.
We will use reasonable efforts not to disclose:
- Customer names
- Street addresses
- Personal documents
- Family photographs
- Account information
- Other readily identifying private information
- Customers who do not want photographs of their property used for marketing should notify Tidy Torch at hello@tidytorch.com.
- An opt-out from marketing use does not prevent Tidy Torch from taking photographs reasonably necessary for documentation, safety, quality control, damage investigations, payment disputes, or legal compliance.
Quality Control
Tidy Torch may conduct quality-control measures including:
- Supervisor inspections
- Customer follow-ups
- Digital checklists
- Photographs
- Internal reviews
- Team coaching
- Customer satisfaction surveys
- A supervisor or authorized Company representative may access the property during the scheduled service when reasonably necessary and consistent with the Customer’s access authorization.
Laundry Services
If laundry services are offered and selected, Customers acknowledge that laundering clothing involves inherent risks.
Tidy Torch is not responsible for ordinary risks associated with following reasonable laundering instructions, including:
- Shrinkage
- Color bleeding
- Pre-existing fabric deterioration
- Loss of shape
- Manufacturer defects
- Damage caused by inaccurate or missing care labels
- except where caused by Tidy Torch’s negligence or otherwise required by law.
- Customers should identify delicate, dry-clean-only, specialty, or unusually valuable garments before service.

Electronic Contracting
You agree that transactions with Tidy Torch may be conducted electronically.
To the extent permitted by law, clicking an acceptance checkbox, submitting an online booking after being presented with these Terms, electronically signing a document, approving a quote electronically, or otherwise electronically manifesting agreement may constitute acceptance of these Terms.
Electronic records may be maintained by Tidy Torch as evidence of the transaction.
Insurance
Tidy Torch LLC maintains insurance applicable to its cleaning operations as determined appropriate by the Company.
All insurance is subject to the terms, exclusions, deductibles, coverage requirements, and limits of the applicable insurance policy.
The existence of insurance does not constitute an admission that a particular event, loss, or claim is covered or that Tidy Torch is legally liable for a particular event.
Non-Solicitation And Direct Hiring Of Cleaning Professionals
Tidy Torch invests substantial time and resources in recruiting, screening, onboarding, training, managing, scheduling, and retaining cleaning professionals.
To the extent permitted by applicable Arizona and federal law, Customers agree not to intentionally circumvent Tidy Torch by directly soliciting a cleaning professional introduced through Tidy Torch to perform substantially similar private cleaning services outside Tidy Torch while that professional is actively assigned through Tidy Torch.
Nothing in this provision prohibits lawful communications or conduct that cannot legally be restricted.
Any placement fee, post-service restriction, or other remedy must be expressly stated in a separate applicable agreement or policy and will apply only to the extent enforceable under applicable law.
Website And Online Services
Tidy Torch may provide:
- A website
- Online booking
- Customer portals
- Payment processing
- Automated notifications
- Text messaging
- Online chat
- Scheduling software
- Other digital services
- These services may be provided directly or through third-party technology providers.
Acceptable Use Of Website And Software
You agree not to:
- Use Tidy Torch systems for unlawful or fraudulent purposes
- Interfere with the operation of the website or software
- Attempt unauthorized access to accounts, systems, networks, or data
- Introduce viruses, malware, or harmful code
- Scrape, reproduce, republish, or commercially exploit proprietary content without permission
- Impersonate another person
- Use payment information you are not authorized to use
- Circumvent security measures
- Use the website in a manner intended to harass or harm another person
- Otherwise misuse Tidy Torch systems
Account Security
If Tidy Torch provides Customer accounts, you are responsible for maintaining the confidentiality of your password, access credentials, security codes, and other authentication information.
You agree to notify Tidy Torch if you reasonably suspect unauthorized access to your account.
Intellectual Property
Unless otherwise stated, the Tidy Torch name, branding, logos, website content, photographs owned by the Company, service descriptions, copy, graphics, designs, processes, and other proprietary materials are owned by or licensed to Tidy Torch.
You may not commercially reproduce or distribute proprietary Tidy Torch materials without written authorization except as permitted by applicable law.
Third-Party Services And Software
Tidy Torch may rely on third-party providers for:
- Booking
- Scheduling
- Payments
- Text messaging
- Mapping
- Communications
- Customer management
- Cloud storage
- Website hosting
- Other business functions
- Tidy Torch does not control all acts, omissions, outages, or technical failures of independent third-party providers.
Network Delays And Technology Interruptions
Internet, telecommunications, and electronic systems may experience:

- Data transmission failures
- Payment processing delays

- Synchronization errors

- Other interruptions
- To the maximum extent permitted by law, Tidy Torch is not liable for damages caused solely by third-party telecommunications, internet, hosting, software, or payment-network failures outside Tidy Torch’s reasonable control.
- A failed email, text, push notification, or automated message does not automatically cancel an otherwise valid booking.
- Customers remain responsible for appointments they scheduled unless cancellation is properly communicated under these Terms.

Nothing provided by Tidy Torch constitutes legal, medical, financial, environmental, engineering, mold-remediation, pest-control, restoration, construction, or other specialized professional advice.
Customers should consult an appropriately qualified professional when specialized advice or remediation is required.
Limitation Of Liability

The parties acknowledge that the allocation of risk reflected in these Terms is part of the consideration for the pricing of the services.
Third-Party And Company-Party Protections
To the maximum extent permitted by law, contractual disclaimers and limitations that protect Tidy Torch are also intended to protect its:

- Managers
- Officers
- Employees
- Contractors
- Subcontractors
- Agents
- Affiliates
- Vendors
- Technology providers
- Successors
- Assigns
- where the claim arises from conduct undertaken within the scope of their relationship with Tidy Torch.
- Nothing in this section prevents a claim that applicable law does not permit the parties to waive or restrict.
No Partnership, Joint Venture, Or Customer Agency
Nothing in the Customer’s use of Tidy Torch services creates a:
- Partnership
- Joint venture
- Franchise
- Employment relationship
- Fiduciary relationship
- Agency relationship
- between the Customer and Tidy Torch.
Indemnification For Customer-Created Conditions
To the extent permitted by applicable law, the Customer agrees to be responsible for losses, claims, or expenses resulting from the Customer’s material misrepresentation, unlawful conduct, or failure to disclose a known dangerous condition at the property.
This provision is not intended to require the Customer to indemnify Tidy Torch for Tidy Torch’s own negligence or conduct to the extent such indemnification would be prohibited by applicable law.
Right To Refuse Future Business
Tidy Torch may decline future bookings or terminate an ongoing service relationship for legitimate business reasons, including:
- Nonpayment
- Repeated late cancellation
- Repeated lockouts
- Fraud
- Fraudulent chargebacks
- Abuse or harassment
- Unsafe working conditions
- Material misrepresentation of property conditions
- Illegal activity
- Repeated violations of these Terms
- Requests outside Tidy Torch’s scope of service
- Circumstances making continuation of the relationship unsafe or commercially unreasonable
- Tidy Torch will not refuse services for an unlawful discriminatory reason.
Suspension Or Termination Of Online Services
Tidy Torch may suspend or terminate access to a Customer account or digital service when reasonably necessary to:
- Protect account security
- Investigate fraud
- Prevent misuse
- Comply with law
- Address violations of these Terms
- Discontinue a particular system or service
- Tidy Torch is not liable merely because a digital feature is modified or discontinued, except to the extent otherwise required by law.
Holidays
Tidy Torch may observe federal holidays, Company holidays, or modified schedules.
If a recurring appointment falls on a closure date, Tidy Torch may contact the Customer to reschedule.
Holiday availability is not guaranteed.
Tidy Torch may change its holiday schedule at any time based upon operational needs.

A communication is not necessarily considered received merely because it was sent if delivery failed or the Customer has reason to know that the communication was not successfully transmitted.
Privacy
Tidy Torch may collect information reasonably necessary to:

- Schedule services
- Process payments

- Provide property access
- Maintain service records
- Conduct quality control
- Resolve complaints
- Protect the Company and Customers
- Prevent fraud
- Comply with legal obligations

Changes To These Terms
Tidy Torch may revise these Terms from time to time for prospective services.
Changes may reflect:

Entire Agreement
These Terms, together with any applicable:

- Service checklist
- Payment authorization
- Cancellation policy
- Privacy Policy
- Promotional terms
- Separately signed written agreement
- constitute the agreement between Tidy Torch and the Customer regarding the applicable service.
- They supersede prior oral or written communications concerning the same subject matter except where a separate written agreement expressly states that it modifies these Terms.
Severability
If any provision of these Terms is determined by a court or arbitrator of competent jurisdiction to be invalid, unlawful, or unenforceable, that provision shall be enforced to the maximum extent legally permissible or severed to the minimum extent necessary.
The remaining provisions shall remain in full force and effect.
No Waiver
Tidy Torch’s failure to enforce a provision of these Terms on one occasion does not waive the right to enforce that provision on another occasion.
A waiver is effective only when expressly made by an authorized representative of Tidy Torch.
Assignment
The Customer may not transfer or assign material rights or obligations under a booked service to another person without Tidy Torch’s consent where the transfer would materially affect the service.
Tidy Torch may assign these Terms in connection with a merger, acquisition, sale of substantially all relevant business assets, reorganization, or other lawful business transaction.
Governing Law
Except to the extent federal law controls or applicable law requires otherwise, these Terms and any dispute arising from or relating to these Terms or Tidy Torch services shall be governed by the laws of the State of Arizona, without regard to Arizona’s conflict-of-law principles.
Good-Faith Informal Dispute Resolution
Before commencing arbitration or litigation, the Customer and Tidy Torch agree to make a reasonable, good-faith effort to resolve the dispute informally.
A Customer initiating a dispute should provide written notice describing:

- Nature of the dispute
- Relevant facts
- Requested resolution

Binding Individual Arbitration

Except for claims specifically excluded below and to the fullest extent permitted by applicable law, the Customer and Tidy Torch agree that any dispute, claim, or controversy arising out of or relating to:
- These Terms
- A booking
- A cleaning service
- Payment
- Cancellation
- Property damage
- The website
- Online booking
- Communications
- The relationship between the Customer and Tidy Torch
- shall be resolved by binding individual arbitration rather than in court.
- An agreement to arbitrate means the parties generally submit covered disputes to a neutral arbitrator rather than a judge or jury.
- Nothing in this section requires arbitration of a dispute that applicable law does not permit the parties to arbitrate.
Arbitration Procedure
Unless the parties mutually agree otherwise, arbitration shall:
- Be conducted by a mutually agreed neutral arbitration provider
- Be conducted pursuant to that provider’s applicable consumer arbitration rules
- Occur in Arizona, remotely, or at another mutually agreed location
- Permit each party a reasonable opportunity to present evidence and arguments
- Result in a written or reasoned award when required by applicable rules or law
- If the parties cannot agree on an arbitration provider or arbitrator, either party may seek appointment or other relief from a court as permitted by applicable arbitration law.
- The arbitrator may award any individual remedy available under applicable law that the arbitrator has authority to award.
Court Determination Of Arbitration Agreement
Questions concerning whether an enforceable agreement to arbitrate exists or whether a particular controversy is subject to arbitration shall be determined as required by applicable Arizona and federal arbitration law.
Nothing in these Terms is intended to eliminate judicial rights that governing arbitration law makes non-waivable.
Small Claims Exception
Either party may bring an individual claim in a court of competent jurisdiction that qualifies for small-claims treatment, provided the claim remains individual and within the applicable court’s jurisdiction.
Emergency Or Injunctive Relief
Nothing in the arbitration agreement prevents either party from seeking temporary, preliminary, emergency, or injunctive relief from a court when such relief is legally available and reasonably necessary to preserve rights or prevent immediate harm pending arbitration.
Class Action And Representative Action Waiver
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE CUSTOMER AND TIDY TORCH AGREE THAT COVERED DISPUTES WILL BE RESOLVED ONLY ON AN INDIVIDUAL BASIS.
Neither party will seek to have a covered dispute heard as a:
- Class action
- Collective action
- Consolidated action
- Representative proceeding
- to the extent such waiver is enforceable under applicable law.
- An arbitrator may award relief only to the individual party seeking relief and only to the extent necessary to resolve that party’s individual claim, except where applicable law requires otherwise.
- If this class-action waiver is held unenforceable as to a particular claim or remedy, the effect of that determination will be governed by applicable law.
Jury Trial Waiver
TO THE EXTENT A COVERED DISPUTE IS REQUIRED TO BE ARBITRATED, THE CUSTOMER AND TIDY TORCH UNDERSTAND THAT THEY ARE WAIVING THE RIGHT TO HAVE THAT DISPUTE DECIDED BY A JUDGE OR JURY IN COURT.
For disputes that are not subject to arbitration, any jury-trial waiver shall apply only to the extent separately valid and enforceable under applicable law.
Venue For Non-Arbitrable Disputes
For any dispute that is not required to be arbitrated and is not properly brought in small-claims court, the parties consent, to the extent permitted by law, to jurisdiction and venue in the state or federal courts located in Arizona having proper subject-matter jurisdiction and venue.
Nothing in this provision overrides a venue right that applicable law makes non-waivable.
Arbitration Severability
If part of the arbitration agreement is held invalid or unenforceable, the remaining arbitration provisions shall remain enforceable to the maximum extent permitted by law unless the invalid provision is essential to the agreement such that applicable law requires a different result.

- Limit any remedy that applicable law requires to remain available
- If these Terms conflict with a mandatory provision of applicable law, the mandatory legal requirement controls.

Section headings are provided for convenience and organization only and do not limit the meaning of any provision.
Interpretation
The words “including,” “includes,” and similar terms mean “including without limitation” unless the context clearly requires otherwise.
References to the singular include the plural when appropriate and vice versa.
Electronic Acceptance And Records
The Customer acknowledges that acceptance of these Terms may occur electronically.
A Customer’s electronic acceptance, online booking, electronic signature, payment authorization, or other electronic manifestation of assent may be retained by Tidy Torch as a business record.
Customer Acknowledgment
BY BOOKING OR RECEIVING SERVICES FROM TIDY TORCH, YOU ACKNOWLEDGE THAT:
- You have had an opportunity to review these Terms before the service
- You understand that cleaning results depend upon property conditions and the service level purchased
- You understand the cancellation, rescheduling, access, payment, and re-clean policies
- You agree to provide accurate information concerning the property
- You authorize payment as described in your booking and these Terms
- You understand the limitations of liability contained in these Terms
- You have reviewed the dispute resolution and arbitration provisions
- You agree to be bound by these Terms to the extent permitted by applicable law
